Trust disputes invariably involve friction between beneficiaries and trustees, which often leads to litigation, so James Price and his team at Stewarts are frequently instructed to assist with court applications, both onshore and offshore. Whatever the nature of the dispute, ‘there is usually an international dimension,’ he says.
Price’s team has grown significantly since he set it up over five years ago, and he believes that trusts and estate litigation is only set to increase. ‘This type of work brings with it particular challenges created by events like death, divorce or family breakdown, so lawyers in this area require both emotional intelligence and technical expertise in equal measure,’ he says.
